Warranties for Thatha phones purchased through our authorized retailers in certain regions or countries, and not through thatha.co.za, will vary on the country or region and Thatha authorized retailers’ warranty policies in that country or region. Unless otherwise specified, this warranty covers the hardware components of the Product as originally supplied and does not cover, or partially covers, software, consumable items, or accessories, even if packaged or sold together with the Product. This warranty is only redeemable within the original country or region of purchase. Before purchase, consult with the retailer about the warranty.
The warranty only covers product defects caused by workmanship or build materials. To make a claim, please present your original Proof of Purchase (invoice), model and serial number of the Product, and photo evidence of the Product’s defects to our authorized retailer in the country of purchase.
Any repair and replacement service covered by warranty, along with shipping and handling, will be handled by Thatha authorized retailer and will be free within the warranty period.
Thatha authorized retailers may use rebuilt, reconditioned or new parts and components when repairing any product. Alternatively, authorized retailers may replace the defective product entirely with a rebuilt, reconditioned or new Thatha product.
The warranty does not cover:
Defects or damage resulting from accidents, neglect, misuse or abnormal use; abnormal conditions or improper storage; exposure to liquid, moisture, dampness, sand, or dirt; unusual physical, electrical or electromechanical stress.
Scratches, dents and cosmetic damage, unless caused by Thatha or its authorized retailers.
Defects or damage resulting from excessive force or use of metallic objects on the touch screen.
Devices that have the serial number or the IMEI number removed, defaced, damaged, altered or made illegible.
Ordinary wear and tear.
Defects or damage resulting from the use of the Product in conjunction or connection with accessories, products, or ancillary/peripheral equipment not furnished or approved by Thatha.
Any physical feature defects or damage resulting from improper testing, operation, maintenance, installation, service, or adjustment not furnished or approved by Thatha or its authorized retailers.
Defects or damage resulting from external causes such as collision with an object, fire, flooding, dirt, windstorm, lightning, earthquake, exposure to weather conditions, theft, blown fuse, or improper use of any electrical source.
Defects or damage resulting from cellular signal reception or transmission, or viruses and other software problems introduced into the Product.
Products not purchased on thatha.co.za or using authorized retailers (we recommend you to contact the point of sale for support).
Repair conducted by un-official repair centers.

All content on this site, including but not limited to text, images, code, design and layout, is owned and controlled by Thatha. No part of the site and content may be reproduced, republished or distributed without the express permission of Thatha. Our services are provided on an as-is and as-available basis, without warranty. We reserve the right to modify these terms and terminate our services at any time. By using this website you agree to the terms laid out in this document.
Usage of the site
You grant Thatha the right to use, reproduce, modify and distribute any non-personal, non-confidential content you post. You may not post unlawful, inflammatory, obscene, or otherwise threatening content to our site. Any such content will be deleted and the associated accounts suspended. You may not access unauthorized parts of the site or use the site in any way that will disrupt our services.
Thatha is committed to protecting the privacy of our users. We do not use, store or disclose your information in ways beyond what is outlined in this Privacy Policy. To provide you with our services, we may collect information that can be used to identify you. We will not use that information in ways other than laid out in this document. Thatha reserves the right to change or modify this document at any time.
The information we collect and how it is used

When you visit our website, your IP address geolocation data is used to present you with the most relevant currency and shipping options.

When you open a Thatha Account, we collect your name and email to validate your account and send you notifications.

We share relevant information with various third-party businesses so that they may provide us with services such as email, website analytics, targeted promotions, payment processing, order processing and delivery. Thatha ‘Third Party Policies’ website and devices may contain links and services offered by third parties. For example, online purchases are handled via YOCO, Direct bank Transfer. thathaOS also uses a suite of applications provided by Google. Information collected by such third parties is governed by their own privacy and legal policies.

We may periodically update our Privacy Policy. When we update our Privacy Policy, we will post the most recent date on which the policy was updated.

Any personal information received will only be used to fill your order. We will not sell or redistribute your information to anyone.

Thatha has adopted the following policy concerning copyright infringement in accordance with the Digital Millennium Copyright Act, 17 U.S.C. 512 and EU Directive 2000/31/EC. If you believe that content posted on www.thatha.co.za violates your copyright, please submit a takedown request to admin@thatha.co.za.
Thatha takes copyright and other intellectual property rights very seriously. It is Thatha’s policy to:
-Timely block access to or remove content Thatha believes in good faith may contain material that infringes the copyrights of third parties and
-Remove and discontinue service to repeat offenders.
Procedure for Reporting Copyright Infringements
If you believe that content accessible through thatha.co.za infringes your copyright, please send a notice of claimed copyright infringement containing the following information to Thatha listed below (consult legal counsel or refer to 17 U.S.C. 512(c) to confirm these requirements):
-A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed;
-Identification of the copyrighted works claimed to have been infringed;
-Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Thatha to locate the material. Please include IP address and GMT timestamp for the infringing material when submitting the notice;
-Contact information for the notifying party, such as an address, telephone number and a return e-mail address for reply purposes;
-A statement that the notifying party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
-A statement that the information in the notification is accurate, and under penalty of perjury, that the notifying party is authorized to act on behalf of the owner of the copyright that is allegedly infringed;
-While not legally required by the DMCA, include “copyright violation” in the subject line of your e-mail to flag your DMCA Notice and bypass spam categorization; and
Submit the notice of claimed copyright infringement to Thatha, the email address admin@thatha.co.za.
It is Thatha’s policy:
-To remove or disable access to the content identified in the notice of claimed infringement;
-to notify the subscriber that it has removed or disabled access to the content; and
-to terminate in appropriate circumstances subscribers who are repeat infringers.

For Goods:
If you are not 100% satisfied with your purchase, you can either return your order for a full refund or exchange it for something else. You can return or exchange your purchase for up to 120 days from the purchase date. Returned or exchanged products must be in the condition you received them and in the original box and/or packaging.
For Services:
If you are not 100% satisfied with your purchase, within 120 days from the purchase date, we will fully refund the cost of your order.
Delivery Policy for Tangible/Physical Products
All orders are subject to product availability.
Shipping
If an item in your order is unavailable, we will ship you the part of your order that is available. When that item becomes available, we will ship you the rest of your order. Shipping costs for your order are non-refundable and are based on the weight of the items you order and your location. The date of delivery for your order may vary due to carrier shipping practices, delivery location, method of delivery, and the number of items ordered, and in addition, your order may be delivered in separate shipments.
Additional taxes and charges
Additional shipping charges may apply depending on your location and the size of your order. You are responsible for all taxes applicable to the delivery of your order, including sales tax, value-added tax, customs duties, and excise duties. If there is any damage to the items that you ordered on delivery, you must contact us within 5 days from receipt of your order.
Delivery Policy for Downloadable Digital Products
Upon receipt of your order, you will either be prompted to begin your download immediately or you will receive an e-mail from us with instructions to complete your download. If you are prompted to begin your download immediately, your completion of the download will constitute delivery to you of the item(s) you purchased.
If you receive an e-mail from us with instructions to complete your download, the receipt by you of the e-mail will constitute delivery by us to you of the item(s) you purchased.
In case you are unable to download the item(s) you purchase or you do not receive an e-mail from us with instructions to complete your download, you must contact us within 5 days from the date of your order. If you do not contact us within 5 days from the date of your order, the item(s) you purchased will be considered received, downloaded, and delivered to you.
Delivery Policy for Services
Upon receipt of your order, the services will be performed to you in accordance with the terms applicable to the services that you purchased. The nature of the services you purchased and the date of your purchase may impact the timing of the performance of the services.
